The purpose of this data is to target marketing efforts and send news. This information is stored with an external provider, Intuit, located in the USA. Intuit is certified under the EU-U.S. Data Privacy Framework by the U.S. Department of Commerce, ensuring a sufficient level of security for the transfer of personal data from the EU to the USA. The information is transferred to our partner, Nordsee Holidays, for data analysis and targeted marketing. See also section 6.2.

The processing is based on your consent, and the legal basis is Article 6(1)(a) of the GDPR. We process the data for as long as consent is given. You can withdraw your consent by unsubscribing via the link at the bottom of our newsletters. Additionally, we delete your consent after 12 months of inactivity.

 

2.3 For Contest Participants

If you participate in one of our contests, we will process the following personal data:

  • Address

The purpose of processing this data is to validate your contest entry, and the legal basis is Article 6(1)(a) of the GDPR.

 

Please note that we may take photos during our contests and share them on our website and social media. The purpose is to promote the contest and DIE HYGGELIGE DÄNEN as a whole. The legal basis for this is Article 6(1)(f) of the GDPR.

If you do not wish to be photographed, please let us know at the start of the event. If a photo of you has been shared on our website or social media and you wish to have it removed, please contact us at [email protected].

 

2.4 For Holiday Home Renters

We process the following personal data if you rent a holiday home with DIE HYGGELIGE DÄNEN:

  • Nationality
  • Phone number
  • Email address
  • Payment information / bank details
  • IP address
  • Information about the holiday home you wish to rent, rental period, and any special requests
  • Information you may choose to provide us about your preferences and interests through surveys
  • Name, email address, and date of birth of other guests

 

The purpose of this data is to fulfill our contract and secure your rights in connection with it. It is also used for targeted marketing, including retargeting and profiling. The legal basis for our processing of this personal data is Article 6(1)(b) of the GDPR (contract performance) and Article 6(1)(f) (legitimate interest in managing the customer relationship) to optimize the user experience and functionality on our website, conduct targeted marketing, satisfaction surveys, and manage the contractual relationship. The legal basis for our processing is Article 6(1)(f) of the GDPR.

We retain the information for the period allowed by law and delete it after five years if the tenant has not been active with us. Tenants always have the right to withdraw personal data, except for data necessary to fulfill legal obligations under the Accounting Act.

We store data in our booking/CRM system in Denmark, and we have a data processing agreement with the system provider. Information may be transferred to our partner, Nordsee Holidays, for data analysis and targeted marketing. See also section 6.2.

We also have a data processing agreement with our IT provider, who has access to personal data through the booking system, which integrates with our website.

 

2.5 For Property Owners with a Brokerage Agreement

We process the following personal data about property owners who have entered into a brokerage agreement with us:

  • Name
  • Private address
  • Email
  • Phone number
  • Bank details
  • Information you may choose to provide us through satisfaction surveys
  • Personal identification number for tax purposes (DAC7)

 

The legal basis for our processing of this personal data is Article 6(1)(b) of the GDPR (contract performance) and Article 6(1)(f) (legitimate interest in managing the customer relationship). We retain the information for five years after the brokerage agreement ends, in accordance with the Accounting Act.

We store data in our booking/CRM system in Denmark, and we have a data processing agreement with the system provider.

2.6 For Individuals Who Contact DIE HYGGELIGE DÄNEN via Email

When you contact us via email or the website, we process your name, phone number, email address, postal code, and city, as well as a description of the issue you need help with. The processing is done to provide the requested service, and the legal basis is Article 6(1)(b) and/or Article 6(1)(f) of the GDPR, depending on the nature of the inquiry.

If we become aware that the data is incorrect, we will update the information and notify you accordingly.

 

5 STORAGE AND DELETION OF DATA

We delete your personal data when we no longer need to process it in accordance with the purpose for which it was collected. However, specific legal requirements, such as the Accounting Act, Anti-Money Laundering Act, or Statute of Limitations, may oblige or entitle us to retain the data for a longer period. Data may also be processed and stored for longer if it has been anonymized.

Personal data collected in connection with the rental agreement will generally be deleted 5 years after the end of the calendar year in which you made your purchase. Personal data may be retained longer if we have a legitimate need for extended storage.

Personal data collected in connection with a brokerage agreement will generally be deleted 5 years after the end of the calendar year in which the brokerage agreement expired. Personal data may be retained longer if we have a legitimate need, such as if it is necessary to establish, assert, or defend legal claims, or if retention is required to comply with legal obligations.

Personal data that is part of accounting records is stored for five years from the end of the financial year. The storage period is based on the requirements of Section 10 of the Accounting Act and is intended to comply with applicable law.

As a rule, we retain registration lists for contests for 12 months from the date the event took place. This allows us to evaluate who participated in the event and improve the content of the event if we offer the same event again. We do not use participants' information for purposes such as inviting them again or for general marketing, unless separate consent has been given for this.

 

 6. DISCLOSURE OF INFORMATION

In the cases described above, we share your personal data with other parties, including partners, suppliers, and other actors such as IT providers, providers of customer satisfaction surveys, newsletter services, and similar. These parties only process your personal data in accordance with our instructions and under the terms of the data processing agreements we have entered into.

We may also disclose your personal data to other parties if we are legally required to do so or if it is necessary to provide the service/advice requested by you.

 

6.1 Personal Data to Insurance Company
DIE HYGGELIGE DÄNEN shares your personal data (name, address, email, phone number, order number) with Codan Forsikring. Codan Forsikring insures our renters against cancellations, interruptions, liability for personal belongings, and access to medical assistance. As a renter, your name and nationality will be provided to the holiday homeowner's login. Codan Forsikring is an independent data controller for the processing of your personal data. Therefore, we encourage you to read their privacy policy.

 

6.2 Personal Data to Nordsee Holidays 2019 P/S
DIE HYGGELIGE DÄNEN shares your personal data (name, address, email, nationality, IP address, purchase history, survey responses) with our partner Nordsee Holidays 2019 P/S. Nordsee Holidays is a collaboration between tourism operators in Denmark. Here, you will find a list of partners we share data with. Personal data is transferred to a data hub for the purpose of analyzing customer segments and targeting marketing efforts. This means that, as a customer, you may be exposed to marketing from Nordsee Holidays and its partners via Google and Meta before and during your vacation.

 

7. YOUR RIGHTS

You have the following rights regarding our processing of your personal data:
(a) You have the right to access the personal data we process about you, as well as a range of additional information.
(b) You have the right to have incorrect personal data about you corrected.
(c) In certain cases, you have the right to have personal data about you deleted before our standard general deletion occurs.
(d) In certain cases, you have the right to restrict the processing of your personal data. If you have the right to restrict processing, we may only process the data—apart from storage—with your consent, for the establishment, exercise, or defense of legal claims, or to protect a person or important public interests.
(e) In certain cases, you have the right to object to our otherwise lawful processing of your personal data. You can also object to the processing of your personal data for direct marketing purposes.
(f) In certain cases, you have the right to receive your personal data in a structured, commonly used, and machine-readable format, as well as to have those personal data transferred to another data controller.
